By visiting and using the Site to purchase goods and services provided by Mrs Florist, you agree to the terms and conditions that follow. The terms and conditions also govern the supply of any goods to you by Mrs Florist whether facilitated by the Site or by any other means. If you do not agree to these terms and conditions, you should immediately cease use of the Site. The use of the Site and the provision of goods, services and information to you by Mrs Florist is conditional on your acceptance without modification of the terms and conditions.

These terms and conditions supersede and exclude all prior and other discussions, dealings, representations and arrangements relating to the use of the Site and/or the supply of goods and services by Mrs Florist.

Any failure on the part of Mrs Florist to exercise or any delay in exercising any right, power or remedy pursuant to these terms and conditions does not operate as a waiver. If any term of these terms and conditions in unenforceable or invalid, such term(s) will be severed and the remaining terms will continue to bind the parties.

We reserve the right, at our complete discretion, to change these terms and conditions at any time by posting revised terms on the Site. It is your responsibility to check periodically for any changes we may make to these terms and conditions. Your continued use of this site following the posting of changes to these terms and conditions means you accept the changes.

GENERAL CONDITIONS

We reserve the right to refuse services to anyone for any reason at any time. 

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmission over various networks; and (b) changes to confirm and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without expressing written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms and Conditions.

ORDERS

Mrs Florist has sole discretion to accept or reject any order or any variation or modification of an order. 

Mrs Florist has sole discretion to accept or reject any other cancellation request. Mrs Florist expressly reserves the right to cancel and/or refund any order placed and/or paid for.

If you have entered into a subscription arrangement to receive flowers on a regular basis (weekly, fortnightly or monthly) you agree that your subscription will continue until such time as it is cancelled by you. If you wish to cancel your subscription you must do so at least 1 week prior to your next scheduled delivery.

PRICE

Prices for our products and services are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part of content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.  

DELIVERY

Any online orders placed BEFORE 01:00 pm each day (Monday – Saturday) can usually be delivered on the same day to applicable Melbourne Metropolitan areas depending on the availability of the flowers. Mrs Florist will make all reasonable efforts to fulfill customer needs and requirements, we cannot guarantee the specific delivery times.  Please refer to our Delivery Information page for delivery locations.

Any special urgent deliveries or special delivery instructions can be arranged and these need to be arranged with Mrs Florist prior to placing orders. Any special request can be requested via 0423 014 655 (Mon-Fri 10am – 6.00 pm, Sat 10am – 5.00pm) or hello@mrsflorist.com.au and additional charges may apply depending on the request. 

For Funeral services, we request that customers contact us beforehand or discuss important details with us at the time of order so that conditions will be suitable. 

In case of the recipient is not available to receive the delivery, we will try our best to leave the delivery at a secure location when it is possible to do so. If our driver cannot find a secure location, then we will try our best to make the re-delivery and additional delivery charges may apply. 

PICK UP

Any online orders placed BEFORE 01:00 pm each day (Monday – Saturday) can usually be available for pick up from our store on the same day depending on the availability of the flowers. Pick up orders or special request instructions can also be arranged with our Florist via 0423 014 655 (Mon-Fri 10am – 6.00pm, Sat 10am – 5.00pm) or hello@mrsflorist.com.au.  Alternatively, you can visit our retail store at Shop 1 / 1 Brunswick Road Brunswick East Vic 3057 and customise your flowers and make a purchase. 

PAYMENT

Mrs Florist accepts major credit card and debit card used in Australia including VISA, Mastercard, American Express and JCB. You can choose to enter credit card information directly at checkout or use the alternative payment method such as AfterPay and PayPal if available. No credit card information is stored at our website and all the information entered is securely passed onto gateway company for processing the payment. 

CANCELLATION AND/OR REFUND

Mrs Florist do not accept cancellation of an order or refund once the order has been processed for delivery. Under any circumstances, should you need to cancel the order, please contact us immediately via 0423 014 655 (Mon-Fri 10am – 6.00pm, Sat 10am – 5.00pm) or hello@mrsflorist.com.au to confirm the status of the order. If the order can be cancelled, we will process the refund straight away via our payment service provider and it may take up to 5-10 business days for the refund to be processed. You will receive confirmation emails confirming the order has been cancelled and confirmation emails confirming the refund has been processed shortly after. 

DISCLAIMERS

Your use of the Site is at your sole risk. The Site is provided on an “as is” and “as available” basis. We reserve the right to restrict or terminate your access to the Site or any feature or part of it at any time. Mrs FLORIST does not guarantee that prices or promotions displayed on the site are valid at the time of ordering.

To the maximum extent permitted by applicable law, Mrs Florist expressly disclaims all warranties of any kind, whether expressed or implied, including the implied warranties of merchantability, satisfactory quality and fitness for a particular purpose and any warranties that access to the Site will be uninterrupted or error-free, that the Site will be secure, or that information on the site will be complete, accurate or timely.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, you understand and agree that neither Mrs Florist nor any of its third-party content providers shall be liable for any direct, indirect, incidental, special, consequential, punitive, or any other damages relating to or resulting from your use of or inability to use the Site or from any actions we take or fail to take as a result of electronic mail messages you send us. These include, but are not limited to, damages for errors, omissions, interruptions, defects, delays, computer viruses, your loss of profits, loss of data, unauthorised access to and alteration of your transmissions and data, and other tangible and intangible losses. This limitation applies regardless of whether the damages are claimed under the terms of a contract, as the result of negligence, or otherwise, and even if we or our representatives have been negligent or have been advised of the possibility of such damages.

Mrs Florist requests our customers to provide us with a valid Order Information such as phone number and e-mail address when placing orders. This allows us to contact you in times of mishaps or when we have any queries or concerns.
